Terms of Service

Last updated: October 2026

These Terms of Service apply to all Bare Pilates memberships, private session bookings, group classes, session packs, studio services and use of the Bare Pilates website and booking platform.

By submitting an application, purchasing a session or membership, creating an account, booking or attending a session, or otherwise using our services, you confirm that you have read, understood and agreed to these Terms of Service.

In these Terms, “Bare Pilates”, “we”, “us” and “our” refer to the Bare Pilates business operated by Ellie Mueller.

“Client”, “you” and “your” refer to the person purchasing or using our services.

1. Private Studio & Eligibility

Bare Pilates is a private, appointment-only home Pilates studio located in Barwon Heads, Victoria.

The studio address is private and must not be shared publicly or disclosed to other persons without permission. Breaches of this requirement may result in suspension or termination of a membership or session pack, subject to applicable law.

Sessions are available by application and are subject to studio capacity and availability.

Clients must be at least 18 years of age to participate independently. Clients under 18 may participate only with prior approval and appropriate consent from a parent or legal guardian.

Bare Pilates reserves the right to decline an application or discontinue a client's services where reasonably necessary.

Submitting an application does not guarantee acceptance, availability or access to a particular session time.

You must provide accurate and current contact, payment, emergency-contact and relevant health information when applying or booking.

You are responsible for notifying Bare Pilates if any relevant information changes.

2. Class & Private Session Pricing

Bare Pilates offers group classes and personalised private Pilates sessions with Ellie.

Sessions may incorporate:

  • Mat Pilates;

  • Reformer Pilates;

  • Cadillac / trapeze; or

  • A combination of equipment,

depending on the client's experience, goals, physical needs and the instructor's professional assessment.

The current pricing is as follows:

Service Price (AUD)

Group class $80

Private class $120

Must be used within three months of purchase.

Private membership

2 classes per week $120 per week

3 classes per week $150 per week

Weekly recurring payment; four-week minimum commitment

All prices are stated in Australian dollars (AUD).

The three-month expiry period for a private class begins on the date of purchase, unless another commencement or expiry date is agreed in writing.

Private classes and memberships are personal to the named client and cannot be transferred, shared, resold or used by another person.

All classes are subject to availability, booking requirements, cancellation policies and the other provisions of these Terms.

3. Private Memberships

Bare Pilates offers ongoing private memberships for clients seeking a consistent Pilates practice.

Membership options are:

  • 2× Weekly: $120 per week.

  • 3× Weekly: $150 per week.

Memberships provide the client with their agreed number of private sessions each week and, where possible, a regular reserved session time.

All memberships have a minimum commitment of four weeks.

Memberships are billed weekly from the commencement date confirmed at the time of purchase.

Memberships are personal to the named client and cannot be transferred, shared, assigned or resold.

Membership prices cover the weekly sessions included in the selected membership. Any additional sessions must be agreed upon and paid for separately.

4. Membership Commencement & Billing

Memberships commence from the date of purchase unless another commencement date has been agreed in writing.

Weekly membership payments are processed using the nominated payment method through the applicable payment provider.

The three-class-per-week membership is a recurring weekly arrangement with a minimum commitment of four weeks. The two-class-per-week membership is also billed weekly.

You are responsible for ensuring that your payment details remain current and that sufficient funds are available when payment is due.

If a payment is unsuccessful, Bare Pilates may contact you to arrange payment.

Where a membership payment remains outstanding, access to future sessions may be suspended until the account has been brought up to date, subject to applicable law.

Cancelling a payment authority or payment method does not itself cancel a membership. Membership cancellation must be completed in accordance with the cancellation terms below.

5. Session Packs & Expiry

Private classes purchased individually are subject to a three-month expiry period from the date of purchase, unless otherwise agreed in writing.

Session purchases and packs:

  • Are personal to the purchasing client;

  • Cannot be transferred or shared;

  • Cannot be exchanged for cash;

  • Are subject to availability;

  • Must be used within the applicable validity period; and

  • Are subject to the cancellation and non-attendance policies outlined below.

A session will be treated as used when attended or where the client cancels within the late-cancellation period or fails to attend, subject to applicable law.

Any applicable expiry period will be communicated at the time of purchase.

Unused sessions do not automatically extend beyond their expiry date. Any extension, credit or refund will be considered in accordance with these Terms and applicable Australian Consumer Law.

6. Dedicated Weekly Session Times

Where available, membership clients may have an agreed recurring weekly session time.

A recurring session time is reserved specifically for the client and forms part of the membership arrangement.

Reserved times remain subject to instructor availability, studio closures, public holidays, unforeseen circumstances and reasonable timetable changes.

A membership does not guarantee access to a particular time, day or equipment for the entire membership period where circumstances outside Bare Pilates' reasonable control require a change.

Where Bare Pilates needs to change or cancel a recurring session time, we will make reasonable efforts to offer a suitable alternative.

7. Cancelling a Membership

Memberships have a minimum commitment of four weeks.

After the minimum commitment has been completed, a membership may be cancelled by providing at least two weeks' written notice by email.

The notice period begins on the date Bare Pilates receives the cancellation request.

Membership payments falling due during the notice period remain payable in accordance with the agreed membership terms and applicable law.

Your membership will end once the applicable notice period has expired and all amounts properly due have been paid.

Written confirmation of the cancellation and effective end date will be provided.

Cancelling a payment method or direct debit does not constitute cancellation of the membership.

8. Pausing a Membership

Memberships may be paused by agreement with Bare Pilates.

Pause requests must be made in writing before the requested pause begins.

Where a pause is approved, membership payments and session access will be suspended for the agreed period, subject to any written conditions agreed between the parties.

A pause does not guarantee that the client's usual recurring session time will remain available upon return.

Bare Pilates may consider extended pauses in exceptional circumstances, including significant injury, illness or other circumstances affecting the client's ability to participate.

9. Session Bookings

All sessions must be booked in advance.

Bookings are subject to availability and are only confirmed once the applicable payment or membership has been processed.

Clients are responsible for checking their booking details and attending at the scheduled date and time.

Clients should arrive on time for their session.

Late arrival may reduce the available session time, as sessions will generally finish at their scheduled time.

Where late arrival means a session cannot be safely completed, Bare Pilates may treat the session as used.

10. Cancellations & Rescheduling

Bare Pilates requires at least 24 hours' notice for cancellations or rescheduling.

Where more than 24 hours' notice is provided, the session may be rescheduled subject to availability.

For session purchases, the session may be rescheduled or credited back to the client's available balance, as applicable.

For memberships, the session may be rescheduled where an alternative time is available. Membership sessions are not automatically refundable or transferable to another week.

Where less than 24 hours' notice is provided, the session will be treated as a late cancellation and may be charged in full or deducted from the applicable session balance or membership allocation.

No-shows will be treated as a late cancellation.

Repeated late cancellations or non-attendance may result in the loss of a recurring session time.

These conditions are subject to any rights or remedies that apply under Australian Consumer Law.

11. Illness

Please do not attend the studio if you are experiencing symptoms of a contagious illness or are otherwise unwell.

Where possible, clients should provide at least 24 hours' notice when cancelling due to illness.

Where a client becomes unwell shortly before a session, Bare Pilates may use discretion regarding rescheduling, particularly where attending the studio may pose a health risk to others.

12. Studio Closures & Changes

Bare Pilates may close or modify its operating hours due to public holidays, instructor illness, maintenance, emergencies, personal circumstances or other unforeseen events.

Where Bare Pilates cancels a booked session, reasonable efforts will be made to provide an alternative session.

A session cancelled by Bare Pilates will not be treated as a client cancellation or missed session.

Where an alternative cannot reasonably be provided, an appropriate credit, replacement session, refund or other remedy may be offered as required by applicable law.

13. Health & Medical Disclosure

You are responsible for ensuring that Pilates and physical exercise are appropriate for your individual circumstances.

Before participating in sessions, you must provide accurate information regarding any relevant:

  • Injuries;

  • Medical conditions;

  • Surgeries;

  • Physical limitations;

  • Pregnancy or postpartum circumstances;

  • Pain or discomfort;

  • Medications that may affect exercise; or

  • Advice from a medical or allied-health professional relating to exercise.

You must notify Bare Pilates if your health or physical condition changes.

Bare Pilates may request medical clearance or other professional advice before allowing a client to commence or continue participation where this is reasonably necessary for safety.

Failure to disclose relevant health information may affect our ability to appropriately modify exercises and sessions.

14. Exercise Risk & Participation

Pilates is a form of physical exercise and carries inherent risks, including muscular soreness, physical strain, aggravation of an existing condition, falls and injury.

By participating in Pilates, you acknowledge that you are voluntarily engaging in physical activity.

You agree to:

  • Follow reasonable instructions provided during sessions;

  • Work within your own physical abilities;

  • Communicate pain, discomfort, dizziness or other concerns;

  • Advise your instructor if an exercise does not feel appropriate; and

  • Stop an exercise where instructed or where continuing may be unsafe.

Exercises may be modified, substituted or discontinued where considered appropriate.

Bare Pilates does not guarantee a particular physical, fitness, health or aesthetic outcome.

Pilates instruction does not constitute medical diagnosis, treatment, rehabilitation, physiotherapy or medical advice.

Nothing in this section excludes rights or remedies that cannot legally be excluded under Australian law.

15. Pregnancy & Postpartum

Clients who are pregnant, recently postpartum or experiencing pregnancy-related or postpartum considerations must inform Bare Pilates before participating in sessions.

Appropriate modifications may be required depending on individual circumstances.

Bare Pilates may request medical or allied-health clearance where reasonably necessary to support safe participation.

Clients remain responsible for obtaining appropriate professional medical advice where required.

16. Studio Conduct

Bare Pilates is a private home-based studio and operates as a quiet and considered environment.

The studio address must not be shared publicly or disclosed to other persons without permission. Breaches may result in suspension or termination of membership or session access, subject to applicable law.

Clients are expected to behave respectfully and appropriately while attending the studio.

Clients must:

  • Respect the privacy of the residence and surrounding property;

  • Follow reasonable studio and safety instructions;

  • Treat equipment and property with care;

  • Arrive at their scheduled time;

  • Avoid bringing additional guests unless agreed in advance; and

  • Maintain appropriate behaviour throughout their visit.

Threatening, abusive, discriminatory, inappropriate or unsafe behaviour will not be tolerated.

Bare Pilates may refuse entry or discontinue services where a client's conduct creates a safety concern or materially disrupts the studio environment.

17. Equipment

All Pilates equipment must be used only as instructed.

Clients must not independently adjust, move or use equipment where doing so may create a safety risk.

Any deliberate or unreasonable damage to studio equipment or property may result in the client being responsible for reasonable repair or replacement costs, to the extent permitted by law.

18. Personal Belongings

Clients are responsible for their personal belongings while attending Bare Pilates.

To the extent permitted by law, Bare Pilates is not responsible for personal items that are lost, stolen, misplaced or damaged while attending the studio.

19. Photography & Recording

Clients must not photograph, film or record another client, instructor or private session without prior consent.

Bare Pilates will not knowingly use an identifiable photograph or video of a client for promotional or marketing purposes without appropriate consent.

20. Privacy & Personal Information

Bare Pilates collects personal information required to manage applications, bookings, payments, client records and the safe provision of Pilates services.

Health and movement information provided by clients is treated confidentially and is used only for purposes reasonably necessary to provide services, manage safety, administer the business and comply with legal or insurance requirements.

Personal information will not be sold.

Information may be disclosed to third-party service providers where reasonably necessary to process payments, manage bookings, operate the website or provide other business services.

Further information is available in the Bare Pilates Privacy Policy.

21. Third-Party Platforms & Payments

Bare Pilates may use third-party providers to process payments, manage bookings, communicate with clients and operate its website.

Payment transactions may be processed through Square or another nominated payment provider.

Your use of a third-party service may also be subject to that provider's own terms and privacy policies.

Bare Pilates is not responsible for the independent acts or omissions of third-party providers, except where required by applicable law.

22. Refunds

All purchases are subject to the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded.

Except where required by law, payments are not refundable due to:

  • A change of mind;

  • Failure to attend;

  • Holidays or travel;

  • Changes in personal circumstances;

  • Scheduling conflicts; or

  • Unused sessions.

Where a refund, credit, replacement service or other remedy is required under Australian Consumer Law, Bare Pilates will provide the applicable remedy.

23. Pricing & Changes to Services

Bare Pilates may change its pricing, services, availability, timetable or operating procedures from time to time.

  • Private membership of two classes per week: $120 AUD per week.

  • Private membership of three classes per week: $150 AUD per week, billed weekly with a four-week minimum commitment.

Any price change will apply to future purchases or membership periods and will not retrospectively change the price of a prepaid session.

Where a material price increase applies to an ongoing membership, reasonable notice will be provided before the new price takes effect.

Clients may cancel their membership in accordance with the cancellation provisions above.

24. Membership & Service Termination by Bare Pilates

Bare Pilates may suspend or terminate a client's membership or services where the client:

  • Repeatedly breaches these Terms;

  • Fails to make required payments;

  • Engages in unsafe or inappropriate conduct;

  • Deliberately damages studio property;

  • Provides materially false information; or

  • Presents circumstances where continuing participation is reasonably considered unsafe or inappropriate.

Where appropriate, the client will be notified of the issue before services are discontinued.

Where Bare Pilates terminates a prepaid service for reasons unrelated to the client's conduct or breach of these Terms, any applicable unused amount will be addressed in accordance with Australian Consumer Law.

  • Unauthorised conduct of another person; or

  • Circumstances outside our reasonable control.

Where liability may legally be limited, it will be limited to the maximum extent permitted by applicable law.

29. Events Outside Our Control

Bare Pilates will not be responsible for delays or failure to provide services caused by circumstances outside our reasonable control, including severe weather, natural disasters, emergencies, government restrictions, utility failures, technology failures, building access issues or other unforeseen circumstances.
